1. Introduction

Ilystics LLC ("we," "our," or "us"), a limited liability company organized under the laws of the Commonwealth of Virginia, respects your privacy and is committed to protecting it through our compliance with this policy. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you visit our website ilystics.com (the "Service").

Note on Entity Status: Ilystics LLC is a privately owned service operating in the Commonwealth of Virginia. We are not affiliated with any government agency.

2. Information We Collect

2.1 Personal Data

We collect personally identifiable information solely when you voluntarily provide it during registration or payment. This includes:

  • Identity Data: Name, email address, and account credentials.
  • Financial Data: Data necessary to process your payment (e.g., credit card tokenization). We do not store full credit card numbers on our servers; they are processed by our secure third-party payment gateway.

2.2 Commercial Project Data

To provide weather delay analysis, we collect:

  • Geolocation Data: GPS coordinates and addresses of construction sites.
  • Project Specifications: Soil types, start dates, and project durations.

We treat this data as Confidential Commercial Information. We do not sell your project locations or bid data to third parties, competitors, or data brokers.

2.3 Technical Usage Data

We automatically collect certain information when you visit, use, or navigate the Service. This information does not reveal your specific identity but may include device and usage information, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, location, and information about how and when you use our Service.

2.4 Site Analytics

We run our own analytics rather than sending your browsing to a third party. When you view a page we record the page address, the referring address if your browser sends one, and the time. When you click a button we have tagged — for example "generate a free exhibit" — we record which button it was. That is the whole of it.

Specifically, we want to be clear about what we do not do:

  • We set no analytics cookies and use no browser fingerprinting.
  • We use no third-party analytics provider. Nothing about your visit is sent to Google Analytics, Meta, or any advertising network, because we do not use them.
  • We do not build advertising profiles, and we do not sell or share this data.
  • Where we store an IP address alongside a payment or security event, it is stored as a one-way hash rather than the address itself.

We use this to understand which pages and guides are useful and which calls to action work. Blocking it with an ad blocker or privacy extension has no effect on the Service — every feature works normally.

3. How We Use Your Information

We use the information we collect to:

  • Provide, operate, and maintain our Service.
  • Generate the specific weather analysis and PDF reports you request.
  • Process your transactions and manage your subscription.
  • Improve our "Smart Soil" algorithms (using anonymized, aggregated data).
  • Detect, prevent, and address technical issues or fraud.
  • Comply with legal obligations.

4. Sharing of Your Information

We may share information we have collected about you in certain situations. Your information may be disclosed as follows:

  • Service Providers: We may share your information with third-party vendors, service providers, contractors, or agents who perform services for us or on our behalf (e.g., payment processing, hosting, email delivery).
  • Legal Requirements: We may disclose your information where we are legally required to do so in order to comply with applicable law, governmental requests, a judicial proceeding, court order, or legal process.
  • Business Transfers: We may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.

5. Third-Party Data Services

Our Service utilizes third-party APIs. By using Ilystics, you acknowledge that your data may be processed by:

  • Open-Meteo: For historical weather data retrieval.
  • OpenStreetMap (Nominatim): For geocoding addresses to coordinates.

We encourage you to review the privacy policies of these third-party providers.

6. Data Security

We use administrative, technical, and physical security measures to help protect your personal information. These measures include SSL encryption for data in transit and hashing for sensitive credentials. However, please also remember that we cannot guarantee that the internet itself is 100% secure.

7. Data Retention

We will only retain your personal information for as long as it is necessary for the purposes set out in this privacy policy, unless a longer retention period is required or permitted by law (such as tax, accounting, or other legal requirements). When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize it.

8. Your Privacy Rights (Do Not Track)

Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track ("DNT") feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage no uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online.

In practice this matters less here than it would elsewhere, because there is no cross-site tracking to opt out of. As described in section 2.4, our analytics are first-party, cookie-free, and never shared with an advertising network. If you would rather we recorded nothing at all, any standard ad blocker or privacy extension will stop it, and the Service will continue to work normally.
